Understanding Copyright for the Use of Copyrighted Material

According to the Sections 41A and 45 of the Hong Kong Copyright Ordinance (Cap. 528) related to copyright in online teaching and production of teaching materials, it stipulates that teachers and students use copyright-restricted materials for teaching and learning in educational institutions, and they are entitled to those exemptions and conditions that must be met.

If EdUHK students want to know about the circumstances under which copyright exemptions can be obtained and the restrictions on the preparation of teaching materials for school practicum (whether face-to-face or online classes).

However, students must note that the above-mentioned exemption is limited to the moment of teaching. If students distribute these teaching materials in other ways, such as distributing them to the public through the EdUHK EOCP network platform, they will have exceeded the exemption clauses of the Copyright Ordinance. If the textbook contains copyrighted material, it is an infringement.

If students need to produce teaching materials and publish them on the EdUHK EOCP or others online platform, but also share them with the public.  They can choose some materials that belong to “Creative Commons” or “Open Access” to avoid copyright infringement. Details on “Creative Commons” and how to retrieve some of the books, images and audiovisual materials officially authorized for the production of teaching materials.
